An appeal of court-martial under the Uniform Code of Military Justice (UCMJ) does not retry the case. Rather, it evaluates the original process for errors. If the sentence resulting from your court-martial was death, a bad-conduct discharge, a dishonorable discharge, dismissal of an officer, or confinement, you can apply for a military review before the Army Court of Criminal Appeals, the Navy-Marine Corps Court of Criminal Appeals, the Air Force Court of Criminal Appeals, or the Coast Guard Court of Criminal Appeals. When reviewing your conviction, the Court will review the case for factual errors, errors in trial procedure, and appropriate sentencing. After the review, the Judge Advocate General may refer your case to the appropriate Court of Criminal Appeals. At the highest level, a court-martial appeal may be reviewed by the United States Supreme Court.
